1. Introduction

Distracted Dad LLC ("Company," "we," "us," or "our") respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use the Distracted Dad mobile application ("App"), website at distracted.dad ("Website"), and related services (collectively, the "Service").

By using the Service, you consent to the data practices described in this Privacy Policy. If you do not agree with the practices described herein, please do not use the Service.

2. Information We Collect

2.1 Information You Provide Directly

  • Account Information: Name, email address, and password when you create an account.
  • Child Profile Information: Your children's first names, ages, birthdays, genders, selected avatars, and preferred colors. This information is provided by you (the parent/guardian) and is used solely to personalize the in-app experience.
  • Subscription Information: Payment and subscription details are processed and stored by the Apple App Store or Google Play Store. We do not directly collect, process, or store your credit card numbers, bank account information, or other financial data.
  • User-Generated Content: Custom rewards you create, session notes, interest/hobby selections, and Partner PIN configurations.
  • Communication Data: Information you provide when you contact us for support, feedback, or inquiries.

2.2 Information Collected Automatically

  • Usage Data: Session activity (start/end times, duration, activities selected, games played, points earned), feature usage patterns, and in-app navigation.
  • Device Information: Device type, operating system, version, unique device identifiers, IP address, browser type, language preferences, and time zone.
  • Analytics Data: App performance data, crash reports, error logs, and diagnostic information.
  • Push Notification Data: Notification preferences, delivery status, and interaction data.

2.3 Information from Third Parties

  • App Store Data: Subscription status, purchase verification, and trial eligibility from Apple App Store or Google Play Store.
  • Analytics Providers: Aggregated and anonymized usage insights from third-party analytics services.

3. How We Use Your Information

We use the information we collect for the following purposes:

  • Provide and operate the Service: Deliver personalized activity suggestions, run in-app games, track sessions and points, manage rewards, and enable Partner Mode.
  • Personalization: Tailor activity and game recommendations based on your children's ages, genders, and your selected interests. AI-powered features use this information to generate relevant suggestions.
  • Analytics and improvement: Understand how users interact with the Service, identify popular features and activities, diagnose technical issues, and improve the overall experience.
  • Communications: Send push notifications (daily reminders, streak alerts, weekly summaries, activity suggestions) based on your notification preferences. Send transactional emails related to your account, subscription, or support requests.
  • Subscription management: Verify subscription status, manage trial periods, and process upgrades or downgrades.
  • Safety and security: Detect, prevent, and address fraud, abuse, security risks, and technical issues.
  • Legal compliance: Comply with applicable laws, regulations, legal processes, or governmental requests.
  • Aggregated insights: Create anonymized, aggregated data sets for research, marketing, and business intelligence purposes. Aggregated data cannot be used to identify any individual user.

4. Children's Privacy (COPPA Compliance)

This section is critically important as our Service involves information about children.

Distracted Dad is designed for use by parents and guardians (adults aged 18+). We do not knowingly collect personal information directly from children under 13 years of age. Children do not create accounts, log in, or interact with the Service independently.

What we collect about children: Child profile information (first name, age, birthday, gender, avatar, color preference) is provided exclusively by the parent/guardian account holder. This information is used solely to personalize the in-app experience for that parent's account.

How children's information is used: Children's profile information is used exclusively to: (a) personalize activity and game suggestions based on age and gender; (b) display child-specific session tracking, points, and rewards within the parent's account; (c) generate age-appropriate content through AI features; and (d) provide per-child analytics to the parent.

Children's information is NOT used for: Advertising, marketing to children, profiling children, selling to third parties, or any purpose unrelated to the parent's use of the Service.

Parental rights: As the parent/guardian, you may at any time: (a) review the child profile information you have provided; (b) edit or update child profile information; (c) delete a child's profile and all associated data; or (d) request that we delete all information related to your children by contacting us at hello@distracted.dad.

If we become aware that we have inadvertently collected personal information directly from a child under 13 without verified parental consent, we will take immediate steps to delete that information.

5. How We Share Your Information

We do not sell your personal information. We do not sell your children's information. We will never sell your data.

We may share your information in the following limited circumstances:

  • Service providers: We share information with third-party service providers who perform services on our behalf, including cloud hosting, analytics, crash reporting, push notification delivery, and customer support tools. These providers are contractually obligated to protect your information and may only use it for the purposes we specify.
  • AppsFlyer (attribution analytics): We use AppsFlyer to measure app install attribution and marketing campaign performance. AppsFlyer receives anonymized device-level data (device type, OS, install source) from the adult account holder only. No children's personal information, child profile data, session data, or in-app activity data is shared with AppsFlyer.
  • App stores: Apple App Store and Google Play Store receive information necessary to process subscriptions and verify purchases.
  • Legal requirements: We may disclose information if required to do so by law, regulation, legal process, or governmental request, or if we believe disclosure is necessary to protect our rights, your safety, the safety of others, investigate fraud, or respond to a government request.
  • Business transfers: In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you via email and/or prominent notice on the Service of any change in ownership or uses of your personal information.
  • Aggregated/anonymized data: We may share aggregated, anonymized, or de-identified information that cannot reasonably be used to identify you for research, marketing, analytics, and business purposes.
  • With your consent: We may share your information for any other purpose disclosed to you with your explicit consent.

6. Data Retention

We retain your personal information for as long as your account is active or as needed to provide you the Service. Specifically:

  • Account data: Retained for the lifetime of your account plus 90 days after account deletion to allow for account recovery.
  • Session and activity data: Retained for the lifetime of your account. Historical session data is part of the core Service experience (analytics, streaks, insights).
  • Child profile data: Retained until you delete the child's profile or your account. Deletion is permanent and irreversible.
  • Payment/subscription data: Managed by Apple App Store or Google Play Store per their retention policies. We retain subscription status records for billing dispute resolution.
  • Analytics and usage data: Anonymized analytics data may be retained indefinitely for product improvement.
  • Legal obligations: We may retain certain information as required by law, for legitimate business purposes, or to resolve disputes.

7. Data Security

We implement commercially reasonable administrative, technical, and physical security measures to protect your personal information, including:

  • Encryption of data in transit (TLS/SSL) and at rest
  • Secure authentication and password hashing
  • Regular security assessments and monitoring
  • Access controls limiting employee access to personal data on a need-to-know basis
  • Secure cloud infrastructure from reputable providers

However, no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to protect your personal information, we cannot guarantee its absolute security. You are responsible for maintaining the security of your account credentials.

8. Your Rights & Choices

8.1 Account Controls

Through the App's Settings, you can: update your profile information, edit or delete child profiles, change your password, manage notification preferences, and manage your subscription.

8.2 Push Notifications

You can opt out of push notifications at any time through the App's Settings or your device settings. Opting out of notifications does not affect your ability to use the Service.

8.3 Account Deletion

You may request deletion of your account and all associated data by contacting us at hello@distracted.dad or through the App's Settings. Upon receiving a verified deletion request, we will delete your personal information within 30 days, except for information we are required or permitted to retain by law.

8.4 Data Portability

You may request a copy of your personal data in a structured, commonly used, machine-readable format by contacting us at hello@distracted.dad.

9. California Privacy Rights (CCPA/CPRA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA):

  • Right to Know: You have the right to request disclosure of the categories and specific pieces of personal information we have collected about you.
  • Right to Delete: You have the right to request deletion of personal information we have collected, subject to certain exceptions.
  • Right to Correct: You have the right to request correction of inaccurate personal information.
  • Right to Opt-Out of Sale: We do not sell personal information. We do not sell the personal information of minors under 16 years of age.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your privacy rights.
  • Right to Limit Use of Sensitive Information: You have the right to limit the use and disclosure of sensitive personal information.

10. European Privacy Rights (GDPR)

If you are located in the European Economic Area (EEA), United Kingdom (UK), or Switzerland, you have additional rights under the General Data Protection Regulation (GDPR):

  • Legal Basis: We process your data based on: (a) your consent; (b) the necessity to perform our contract with you (providing the Service); (c) our legitimate business interests; or (d) legal obligations.
  • Right of Access: Right to obtain a copy of your personal data.
  • Right to Rectification: Right to correct inaccurate personal data.
  • Right to Erasure: Right to request deletion of your personal data ("right to be forgotten").
  • Right to Restriction: Right to restrict our processing of your personal data.
  • Right to Data Portability: Right to receive your data in a structured, machine-readable format.
  • Right to Object: Right to object to our processing of your personal data.
  • Right to Withdraw Consent: Where processing is based on consent, you may withdraw consent at any time.

International Transfers: If you are located outside the United States, your information may be transferred to and processed in the United States. We implement appropriate safeguards (such as Standard Contractual Clauses) for such transfers.

11. Third-Party Services

The Service may use or integrate with the following categories of third-party services:

  • Cloud hosting and infrastructure (data storage and processing)
  • Analytics and crash reporting (app performance and usage patterns)
  • AppsFlyer (mobile attribution and marketing analytics — used to understand how users discover and install the app. AppsFlyer does NOT receive children's data. Only anonymized, aggregate install and conversion data from the adult account holder's device is shared.)
  • Push notification services (delivering notifications)
  • AI/machine learning providers (generating activity suggestions and trivia content)
  • App stores (subscription and payment processing)

Each third-party service operates under its own privacy policy. We encourage you to review their policies. We select providers that maintain appropriate data protection standards and enter into data processing agreements where applicable.

12. AI & Automated Decision-Making

Our Service uses artificial intelligence to generate personalized activity suggestions and trivia questions based on your children's ages, genders, and your selected interests. This processing is necessary to provide core Service functionality.

AI-generated content is not used to make decisions that produce legal or similarly significant effects on you. You always have the choice to accept, reject, or request new suggestions. No automated decisions are made regarding your account status, subscription, or access to features.

13. Do Not Track

Some browsers include a "Do Not Track" (DNT) feature. There is currently no universally accepted standard for how companies should respond to DNT signals. We do not currently respond to DNT signals, but we do not engage in cross-site tracking of our users.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you via email (using the email address associated with your account), in-app notification, or by posting a prominent notice on the Service prior to the change becoming effective. The "Last updated" date at the top of this policy indicates when it was last revised.

Your continued use of the Service after any modifications to this Privacy Policy constitutes acceptance of the updated policy.
